The portal, eatsmarter.com, is operated by EAT SMARTER, 23410 Civic Center Way, Suite E8, Malibu CA 90265. We treat your data as strictly confidential and will, therefore, have our employees committed to maintain confidentiality. Measures to protect against falsification, loss, destruction, manipulation, and unauthorized access of your personal data have been taken by EAT SMARTER.

EAT SMARTER will use your data exclusively for the fulfillment of the purposes explained below. We also will explain how we collect your personal data, how it will be used, and why it is important for us to collect this data to better communicate with you.

2. Collection, Processing and Use of Personal Data

EAT SMARTER defines personal data as any information that draws the connection that you are an EAT SMARTER user. This includes information such as your email address, city, birth date, pages you visit, time of day you visit, gender, and IP address. The collection, use and storage of this data is based on what you have provided to us voluntarily. For any information that requires legal consent, we will separately direct you on these instances to properly withdraw information (see below).

EAT SMARTER also collects information we refer to as non-identifying information, this information is provided to us via your registration and use of the site. This includes data such as your food preferences, zip code, and other individual preferences.

You are able to use EAT SMARTER as a guest, without having to register. However, if you want to save your favorite free recipes, you will have to register as an EAT SMARTER user (registering allows us to collect information about you). This is done for the primary purpose of modification or justification. The data you enter is essential for the use of EAT SMARTER service and the implementation of the Membership Agreement.

EAT SMARTER collects, processes, and uses the personal information you provide for personalized advertising, providing personalized information about our services via our newsletter, and for the improvement of our services to better fit the needs of our users.

  1. Inventory data- Your personal data, such as that needed for the amendment, establishment, or content of a contractual relationship (inventory data), is exclusively for handling between you and EAT SMARTER. We require your explicit consent for any additional use of your inventory data for the purpose of advertising. Said consent can be explained by the registry, and is approved by subscribing to our newsletter. Your consent is completely voluntary, you can withdraw at any time by contacting us as detailed at the end of this document with effect for the future, you can remove your newsletter consent through your EAT SMARTER account or by emailing us at info@eatsmarter.com.

  1. Usage data- We collect, process, and use personal data about the active dates of an EAT SMARTER user, how they use the site, and any other pertinent information that will make us able to better meet the needs of our users. The collection of this data, which is essential for the best EAT SMARTER experience, helps us make your visit more secure and easier to navigate.

We will create profiles for our users with the aid of pseudonyms that will be used for the

purpose of market research, advertising, and the customized design of EAT SMARTER. Users have the right and the ability to contradict our use of data by reaching out to us at info@eatsmarter.com.

3. Disclosure of personal data

If we use an outside source to collect, process or use your data it is done solely in the context of order data processing. In an order, a contract is awarded to a business partner (contractor), included in this contract is the requirement to maintain personal data protection. In the case of these contracts, EAT SMARTER remains responsible for the legal privacy of application data processing. EAT SMARTER is authorized to give these contractors information.

4. Deletion of personal data

Your personal data is deleted when the legal retention requirements do not impede it or if you make a cancellation claim. You are able to delete your account or unsubscribe from newsletters on EAT SMARTER user the ‘Profile’ tab or you can go here to unsubscribe.

Your personal data is deleted if the data is no longer necessary for the fulfillment of its purpose, or when there is a legal reason which makes the storage of data inadmissible.

5. Cookies

We use cookies, which are small pieces of data that are stored on your hard drive, on EAT SMARTER to improve user browsing experience. We also use session cookies, such as ‘remember me’ (which recognizes a returning user), but these are deleted automatically upon logout or closing your browser.

You can delete the corresponding browser function (cookie) at any time. To do this you must go to your browser settings. Keep in mind that the individual features of EAT SMARTER may not function properly after the deletion of cookies and/or the deactivation of cookie usage.

6. Amazon affiliates

EAT SMARTER participates in a partnership program with Amazon. This program acts as a medium for websites to earn referral fees through the placement of advertisements and links to amazon.com. The use of cookies tracks your orders, allowing you to recognize when you have been linked via EAT SMARTER. For more information about the way Amazon uses your data, please refer to their privacy statement.

7. Remarking advertisement

EAT SMARTER presents users with personalized, interest-based advertisements through the use of of remarking technologies. Information about your browsing habits are collected and saved via cookies to your computer under pseudonyms of personal data. Third parties connect to this data and create ads.

Any association with another third-party by way of a banner ad, link to their website, or any other type of advertisement is in no way an endorsement or representation of an affiliation with said third party.

8. Advertising

This Site is affiliated with CMI Marketing, Inc., d/b/a CafeMedia ("CafeMedia") for the purposes of placing advertising on the Site, and CafeMedia will collect and use certain data for advertising purposes. 9. Google Adsense

At EAT SMARTER we use Google Adsense, an advertising service of Google Inc. (“Google”), 1600 Amphitheater Parkway, Mountain View, CA 94043, USA. In addition to cookies, Google Adsense uses small graphic files that are not visible to the user, called beacons.

This allows Google to evaluate web activity on EAT SMARTER, including other information such as your IP address (all of which is covered under the policy). Google processes the information collected through cookies and beacons to display advertisements on EAT SMARTER and to create reports for us on user activity.

The information collected through Google Adsense is transmitted to and stored by Google. This data can then be shared from Google to other contracts they hold, your personal IP address will not be associated with other data collected from you.

You have the choice to refuse the use of cookies and beacons through your browser settings.

10. Statistical data

  1. Server statistics- EAT SMARTER uses service-side statistics for internal analysis. This data is stored automatically and is sent by your browser. Typically, this data has no specific reference to individual users as the collection of IP addresses is carried out in an abbreviated form. There is no combination of the IP address and stored data from other sources. In general, it concerns the following stored data: browser type and version, URL of referer, hostname of accessing computer (IP), operating system, and the time of service request.

  1. Google Analytics- EAT SMARTER uses Google Analytics, a web analytic service provided by Google Inc. (“Google”), 1600 Amphitheater Parkway, Mountain View, CA 94043, USA.

Google analytics employs the use of cookies, which allows the analysis of your use of the EAT SMARTER website. The data generated is typically transferred to and stored by a service of Google. Our use of Google Analytics is done exclusively with IP anonymity. On our behalf, Google uses this information to evaluate your use of EAT SMARTER, creating reports on website activity and other internet related services for us.

Google Analytics will not merge your IP address with other data. You can opt out of this by turning off cookies in your browser settings.

In addition, through the use of a plug-in, you can prevent data (collected by cookies and related to the way you use websites) from being sent to Google. This opt-out cookie will prevent the collection of your information from EAT SMARTER in the future.

11. Use of social plugins

Included on certain pages of EAT SMARTER are social plugins to external social networks such as Facebook, Twitter, Pinterest, and Google+. A page that contains a social plugin will sometimes cause your browser to establish a direct connection with the servers of the respective social networks. The contents of these social networks are directly transmitted to your browser and integrates into our service. EAT SMARTER does not influence the scope of the data collected by the respective social network. We, therefore, inform accordingly to our knowledge:

  1. Facebook-  We employ the use of specific subpages of EAT SMARTER for social plugins of the social networking site Facebook, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA. By activating the plugin, Facebook receives the data about the information and buttons on EAT SMARTER you have accessed. If you are logged into Facebook, Facebook can connect your EAT SMARTER visit to your Facebook account. If you interact with the plugins, and for example you press the ‘share’ button, the corresponding information is sent directly to Facebook, where it is stored. There is still the possibility of Facebook getting your IP address and storing it, even if you are not a Facebook member.

  1. Twitter- We employ the use of specific subpages of EAT SMARTER as a social plugin for the social networking site Twitter, which is operated by Twitter, Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103. By activating and pressing the ‘Tweet’ button, your account is associated with EAT SMARTER and notifies other users.

For additional information, refer to the privacy statement of Twitter. The privacy settings on your Twitter account can be changed under account settings.

  1. Pinterest- We employ certain subpages of EAT SMARTER as social plugins for the social networking site Pinterest, which is operated by Pinterest, Inc., 808 Brannan Street, San Francisco, CA 94103, USA. By activating the plugin and using the ‘Pin It’ button, your page visit is linked to your Pinterest board and shared with other users. This data is transmitted to Pinterest, EAT SMARTER receives this data which we use via Pinterest.

  1. Google+- We employ certain subpages of EAT SMARTER for social plugins of the social networking site Google+, which is operated by Google. By activating the plugin and pressing the ‘Google+1’ button, you link your EAT SMARTER visit with your Google+ account and notify others in your circle. The information you provide will be sorted by Google for content and information you have viewed. Google will use your ‘+1’ as evidence along with your profile and photo, such as in your Google profile, search results, or elsewhere on websites and ads across the internet.

To further develop Google services, Google records beyond this information to inform about your Google+ activities. You must posses a globally visible and public Google profile to use the Google+ button, this Google profile must contain at least the chosen name for the profile. This profile name is used in all Google services, and in some cases this name can also act as a substitute for any other name which you have used when using your Google account to share content. The identity of your Google profile can be shown to users who know your personal identifying information, such as your email address.

In addition to the use outlined above, any information you provide in accordance with the Google privacy policy will be used. Google has the right to release summary statistics to users and partners (such as publishers, advertisers, or linked sites) on the activity of users or Google+ information. EAT SMARTER reserves the right to use, sell, share, and provide access to any personally identifiable information we receive through any third-party social networking sites. This information collected about you, your mobile, your computer, or any other devices is subject to the same privacy policy as all other information collected by EAT SMARTER.

12. Data security

  1. EAT SMARTER, just as any other site, is not able to guarantee the security of the personal information you provide to us through your use of the site. There is always the risk of the information we collect and store becoming compromised. By using the EAT SMARTER site you assume all risk connected to the information you provide to us through your use, registration, and access of the site. EAT SMARTER is not responsible for the loss of any personal information that is stored with us, whether it is through an electronic breach or through the loss of your personal computer, mobile device, or other device. In the unlikely event that we do have a security breach and the information you provided to us may have become compromised, we will work to notify you.

  1. EAT SMARTER reserves the right to share the information stored in our database with any affiliates, subsidiaries, or select partners we feel offer services or products that may be of interest to you. If you prefer that your personal information not be shared with third parties, please contact us using one of the methods detailed at the end of this document.  

  1. If you no longer wish to receive commercial communications from us, you can simply unsubscribe from these messages by following the unsubscribe instructions detailed in our email messages.

  1. EAT SMARTER will provide access to our database to law enforcement, government agencies, and/or private parties in order to cooperate with official investigations, search warrants, subpoenas, court orders, and/or other legal proceedings.

  1. EAT SMARTER reserves the right to sell, use, transfer, and share aggregated data about our users as an anonymous group for any lawful business such as finding compatible advertisers, usage trends, and new clients or customers.

  1. In the event that all or some of EAT SMARTER’s assets are sold, transferred or acquired by another company, the information we have collected from our users may be part of the assets that are transferred.

  1. EAT SMARTER is not intended for use by children under the age of the 13. Those who are under the age of 13 are not allowed to register to use the EAT SMARTER site or provide any personal information. This includes any use of our social media accounts, media galleries, blogs, discussion boards, and/or any other portion of our site. Those who are between the age of 13 and 17 must get permission of their parent(s) or legal guardian(s) before the use of the EAT SMARTER site and all affiliated accounts.

Information your child provides or discloses in any public area on the EAT SMARTER site may make them the target of unsolicited messages from third parties. If you become worried about your child’s use of the site, please contact us using one of the methods provided at the end of this document.

California’s “Shine the Light” law, Civil Code section 1798.83, requires certain businesses to disclose what personal information or data has been shared with third parties for marketing purposes, at the request of any customer or user. If you wish to opt-out of EAT SMARTER’s sharing of your information with third parties for the purpose of direct marketing, please contact us using one of the methods detailed at the end of this document.

The information you provide to us and/or the information we collect about your usage may be stored and maintained on computers that are not located in your state, province, country or governmental jurisdiction. If this is the case, the privacy laws may not be as protective as the laws in your jurisdiction. If you reside outside of the United States and provide information to EAT SMARTER, we will transfer your information to the United States where it will be processed and maintained. By agreeing to this privacy policy, you agree to the transfer of your information to the United States.  

13. Your rights

At your request and free of charge, we will inform you in writing which personal data of your we have saved. If it is found that we have saved incorrect data, we will correct it, you have the right to clock or delete your personal data.
